These Terms and Conditions apply to the Book Of Memories websites (the “Website”) and other services offered (together the “Services”). Front Runner Professional (“Company,” “we,” “us,” or “our”) reserves the right at any time to change or update these Terms and Conditions (“changes”), either fully or partly, for any reason. We’ll note when these Terms and Conditions were last updated. Changes will take effect at least fourteen (14) days after posting unless they relate to new features or legal reasons, in which case they take effect immediately. Continuing to use the Services after changes means you accept the updated Terms and Conditions.
Eligibility: If you’re under 18, you need consent to use the Services. Users aged 13-17 can only use them if a parent or legal guardian over 18 agrees to these Terms and supervises your use. The Company can refuse service or cancel Campaigns, Donations, or Services anytime without liability.
Definitions: In these Terms “Campaign Organizers” are those raising money through fundraising campaigns called “Campaigns.” “Donors” give money called “Donations.” Together with visitors using the Services, they’re all called “Users.” This includes anyone named as a beneficiary of Campaigns too.
Services: The Services work as a platform (“Platform”) for Users where Campaign Organizers post Campaigns to get Donations from Donors. There’s no charge to start a Campaign but we keep part of each Donation as fees for our Service plus fees for third-party payment processors. We may change or stop the Services temporarily or permanently without notice but won’t be responsible for losses caused by that. Also, we aren’t liable if data is lost or not saved on our system. Using mobile devices might involve charges from your carrier and some features might not work on all phones or networks. You also agree we can send messages about our Service by SMS/MMS/text to your device and receive info about how you use it.
Charitable Giving: Campaigns aren’t registered charities so Donations aren’t tax-deductible gifts. Some third parties process payments deducting their fees besides ours (“Front Runner Professional Fee”). The Company is not a charity nor does it ask for donations on its own behalf; it just handles payments between Donors and Campaign Organizers.
Administrative Platform Only: The Company just facilitates payments between Donors and Campaign Organizers but isn’t involved in agreements between them nor acts as an agent or financial institution here. We don’t control what Campaign Organizers do or say and aren’t responsible if things go wrong with a Campaign’s success or how funds are used – that’s up to Donors who decide voluntarily whether to donate after checking everything out themselves first because there’s no guarantee funds are spent as promised by organizers. Tax treatment of donations is also up to donors alone. We make no promises about quality , safety , legality , or results of any campaigns.
No Verification of Campaign Information: We don’t check facts provided by Campaign Organizers nor confirm if Donations are spent properly according to law. We have no duty regarding how funds get used.
Your Registration Obligations: To access certain parts of the Services , registration may be required. You promise that information given during sign-up is accurate , current , complete – including real names & pictures if you’re organizing campaigns. Those under 13 can’t use our Service even with registration ; users 13-17 need parental approval before registering/using it. Some features depend on third-party providers like payment processors where separate accounts & terms apply ; while we might help set that up sometimes , we’re not responsible if those providers mess up their side.
Public Display of Donations: Donors can choose whether their donations show publicly on the site /to campaign beneficiaries ; otherwise donation info stays private if selected during checkout. Check our Privacy Policy for details on how personal data is collected & handled.
Payment of Donations: To donate you’ll provide us with credit card info (VISA / Master Card / Discover / American Express ) or another method authorized by you. You confirm this info is true & belongsto you ; minimum donation amounts could apply & all payments are final – no refunds allowed ! Keep account details updated so charges go through smoothly until you cancel recurring donations via Platform.
Fees: There’s no upfront fee when starting a campaign here but we take four percent (4%) from each Donation (“Front Runner Professional Fee”) plus fees charged by payment processors (“Processing Fee”). By donating, you accept both our terms plus those imposed by payment providers.
• For US users only : Third party processor charges 2.9% plus $0.30 per donation for VISA , Master Card , Discover cards ; 3.4% plus $0.30 per donation applies for American Express cards.
• For Canadian users only : Same fee structure applies – 2.9% + $0.30 per gift for most cards except Am Ex which takes 3.4 % + $0.30.
All Fees get deducted automatically from every Donation received before organizers withdraw anything. We reserve right to update Fees at any time but will notify at least fourteen days ahead via Website /other channels whenever possible. You keep using service afterward means agreement with new Fees.
Indemnification : You agree not hold Company /affiliates responsible over losses /claims arising from your usage of service, donations made, campaign involvement, breech against rules, respect others’ rights, etc. If living in California, you waive specific Civil Code Section related protections; same goes elsewhere based on local laws.

LIMITATION OF LIABILITY : NEITHER COMPANY NOR ITS AFFILIATES SHALL BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES SUCH AS LOST PROFITS, DAMAGE TO GOODWILL OR DATA EVEN IF WARNED. PENALTIES ARE LIMITED TO AMOUNTS PAID IN LAST SIX MONTHS BUT NEVER OVER $100.
EXCLUSIONS : SOME PLACES MAY NOT ALLOW LIMITATIONS HERE SO THEY MIGHT NOT APPLY. IF UNSATISFIED WITH SERVICE OR TERMS, YOUR ONLY OPTION IS STOP USING IT.
DISPUTE RESOLUTION – ARBITRATION (READ CAREFULLY): ANY DISPUTES BETWEEN YOU AND COMPANY MUST GO THROUGH ARBITRATION EXCEPT SMALL CLAIMS CASES. Notice must be sent within sixty days describing claim/demand before arbitration starts. Arbitration follows AAA commercial rules mostly held in Chicago unless agreed otherwise. Both sides waive rights for class actions; arbitrator decides scope/enforceability. If waiver found invalid whole arbitration clause voided.
